The certificate of Algerian nationality is the document by which a person proves that he has Algerian nationality.

Conditions of award :

1. By descent: a child born to an Algerian father or an Algerian mother

2. a child born after the father or mother has acquired Algerian nationality.

3. a person whose court has proved that his father or mother is of Algerian nationality.

4. a child born in Algeria of unknown parents, article 7, paragraph 1, of the Algerian Nationality Code

5. A child born in Algeria of an unknown father and of a mother whose only name appears on his birth certificate without any further indication of her nationality.

6. On proof of a court decision, Article 36 of the Algerian Nationality Code

Documents requested :

By descent: a child born to an Algerian father or an Algerian mother

1. In relation to the father : three cases can be distinguished:

  • The first case : a child born to a father of Algerian nationality of origin:

The certificate of nationality is issued in this case on presentation of the following supporting documents:

- The act of the person concerned (full copy E.C 7).

- The father's birth certificate (full copy E.C 7) or death certificate (full copy E.C 9) when it includes the date and place of birth

- Grandfather's birth certificate (full copy E.C 7) or death certificate (full copy E.C 9) when it includes the date and place of birth.

Persons born abroad are considered to have been born in Algeria provided that their birth is transcribed in the civil status registers of the consular district at the Ministry of Foreign Affairs within the prescribed deadlines, in accordance with the provisions of Law No. 70-20 of 19 February 1970 on civil status, as amended and supplemented, in particular Articles 95 to 111.

  • Second case : the child born after the father or mother acquired Algerian nationality:

The certificate of nationality is issued in this case on presentation of the following supporting documents:

- The birth certificate of the person concerned (full copy E.C. 7), certifying that he was a minor when his father acquired Algerian nationality in accordance with the provisions of article 17 of the Algerian Nationality Code

- A copy of the decree acquiring Algerian nationality for the father.

  • The third case : the one in which the court has proved that the father is of Algerian nationality of origin:

The following documents are requested:

- The birth certificate of the person concerned (full copy E.C 7),

- The father's birth certificate (full copy E.C 7) or death certificate (full pie E.C9) when it includes the date and place of birth

- An enforceable copy of the court decision having the force of res judicata, justifying to the father his Algerian nationality of origin.

2. In relation to the mother : in the following three cases:

  • The first case : the child born to a mother of Algerian nationality of origin

The following documents are requested:

- Birth certificate of the person concerned (full copy E.C 7),

- Mother's birth certificate (full copy E.C7),

- Birth certificate of his father (full copy E.C 7), or death certificate (full copy E.C 9) when it includes the date and place of birth

- The birth certificate of his grandfather (full copy E.C 7), or death certificate (full copy E.C 9) when it includes the date and place of birth

  • Second case : a child born to a mother who has acquired Algerian nationality, article 17 of the Algerian Nationality Code.

The following documents are requested:

- The birth certificate of the person concerned (full copy E.C. 7), certifying that he was a minor when his mother acquired Algerian nationality in accordance with the provisions of the above-mentioned article 17,

- A copy of the decree acquiring Algerian nationality by the mother.

  • The third case : the one in which the court proved that his mother is of Algerian nationality of origin, article 36 of the Algerian law on nationality:

The following documents are requested:

- The birth certificate of the person concerned (full copy E.C 7),

- The birth certificate of the mother (e) (full copy E.C 7),

- An enforceable copy of the court decision having the authority of the force of justice, proving to the mother her Algerian nationality.

3. By birth in Algeria, Article 7 of the Algerian Nationality Code, there are two cases:

  • The first case : a child born in Algeria of unknown parents, article 7, paragraph 1, of the Algerian Nationality Code:

The following documents are requested:

- Birth certificate of the person concerned only (full copy E.C 7).

  • Second case : those born in Algeria of a mother named articles 7, paragraph 2 and 32, paragraph 5 of the Algerian nationality code

The following documents are requested:

- Birth certificate of the person concerned (full copy E.C 7),

- A certificate issued by: the juvenile judge, the Directorate for Assisted Children, the national body for the protection and promotion of children, or the hospital administration, proving that the mother whose name is mentioned on the birth certificate of the person concerned is not known.

4. On proof of a court decision, Article 36 of the Algerian Nationality Code:

The following documents are requested:

- Birth certificate of the person concerned (full copy E.C 7),

- An enforceable copy of the court decision having the force of judicata, whose Algerian nationality of origin is justified.
