Authorization to exploit classified establishment: Procedures for granting authorization to exploit a classified establishment

• Environmental Impact Assessment Approval:
  • The promoter elaborates the study by a BET approved by the Ministry of the Environment
  • The promoter submits the study to the Wali
  • The wali transmits the study to the technical services for opinion
  • The posting at the wilaya headquarters of the concerned commune and in two national newspapers
  • The decentralized technical services are seized for opinion
  • The studied file is transmitted for approval by the Wali or Minister of Environment or President of the APC
  • The promoter will be notified of the decision of approval or rejection
  • In case of rejection, the promoter can introduce an administrative appeal and a new examination will be carried out
• Approval of the risk assessment study (EDD)
  • The promoter elaborates the study by a BET approved by the Ministry of the Environment
  • The promoter submits the study to the Wali
  • Examination by the wilaya commission or interministerial commission of the risk assessment study
  • Elaboration of the approval or rejection of the risk assessment study
  • In case of rejection the promoter can introduce an administrative appeal and a new examination will be carried out

• Environmental Audit Approval:
  • The promoter elaborates the study by a BET approved by the Ministry of the Environment
  • The promoter submits the study to the Wali
  • The Wali transmits the study to the technical services for opinion
  • The decentralized technical services are seized for opinion
  • Examination of the audit at the local level by the Wilaya environmental services or by the Ministry services.
  • Elaboration of the approval or rejection of the audit study
  • In case of rejection, the promoter can introduce an administrative appeal and a new examination will be carried out

The Establishment of a prior agreement , will be established, by the wali or minister after approval of the impact and danger studies or after approval of the impact notice and the report on dangerous products

• Decision of prior agreement
• Request for on-site visit of the commission of classified establishments for the establishment of the PV.

The operating authorization , will be established by the president of the municipal people's assembly wali ,minister after after compliance of the establishment with the content of the decision of prior agreement
